1. INTRODUCTION
These Terms and Conditions regulate the provision of consulting and mentoring services by MindfulOps LLC (“Consultant”) to the customer (“Customer”). By contracting MindfulOps services, the Customer accepts the terms set out in this document.
2. SERVICES
2.1 Description of the Services
The Consultant is committed to offering the following services:
- The Business Kickstart: Methodology-based mentoring program Entrepreneur Growth Model (EGM), designed for entrepreneurs who want to establish the strategic foundations for the success of their business. It lasts 90 days and includes 14 sessions, distributed between concept sessions (1—2 hours) and follow-up sessions (30 minutes).
- The MindfulOps Method: Operational consulting focused on the optimization of processes and systems, based on the methodology of the five pillars of MindfulOps. This program lasts 90 days and can only be extended if both parties agree to this in writing in advance.
- Ops Management: Project-based service that includes the assignment of a project manager for the strategic execution of specific initiatives. The duration and scope will be defined according to the nature of the project and will be detailed in an annex agreed between the parties.
2.2 Duration of Services
- The Business Kickstart: 90 days, with a defined schedule of pre-approved sessions.
- The MindfulOps Method: 90 days. Any extension must be agreed in writing before the initial deadline expires.
- Ops Management: The duration will depend on the requirements of the project and will be stipulated in the corresponding annex.
2.3 Transition between Services
Customers who complete The Business Kickstart They will be able to continue with The MindfulOps Method or Operational Continuity.
Terminating Customers The MindfulOps Method they will be able to choose Operational Continuity or go back to The Business Kickstart if they are planning to launch a new product or service.
3. DELIVERY METHOD
The Consultant will have the autonomy to determine the methods, means and details of the provision of services. You may hire employees or sub-consultants (“Operation Managers”) to support you in the execution. These will not be employees of the Customer.
3.1 Use of Third Party Platforms
Some MindfulOps services are provided through third-party technological platforms, such as GoHighLevel, which can be offered under a white label solution. In these cases, MindfulOps acts solely as an authorized intermediary or reseller, without being responsible for the development, infrastructure, or internal operation of that platform.
The Customer acknowledges that:
- The contracting and use of the GoHighLevel platform (or any similar software) is subject exclusively to the terms of service, privacy policies and technical conditions established by the original provider of the software.
- MindfulOps does not guarantee the availability, continuity, security or functionality of the platform, and **will not be responsible for interruptions, technical failures, loss of data or changes in the characteristics of the service** provided by the third party.
- The technical and legal responsibility for the use of the platform lies with the original provider, even if the access was managed or billed through MindfulOps.
It is recommended that the Customer directly review and accept the terms and conditions of the external provider before using these services.
3.2 Use of Automations and Artificial Intelligence
In certain cases, MindfulOps may use automation or artificial intelligence (AI) tools to improve the delivery of its services. These tools won't make relevant decisions without human oversight and are designed to optimize operational efficiency. The Customer can request the exclusion of AI-assisted functionality at any time.
4. CUSTOMER RESPONSIBILITIES
The Customer undertakes to:
- Provide complete and up-to-date information about your operation and objectives.
- Respond to communications from the Consultant in a timely manner.
- Actively participate in scheduled meetings and sessions.
4.1 Liability and Delay Policy
Both the Customer and MindfulOps undertake to follow the established schedule to meet the agreed times.
If either party incurs significant delays in key meetings or in the delivery of information, a rescheduling meeting will be coordinated to adjust priorities and ensure deliverables within the remaining time frame.
The Business Kickstart and The MindfulOps Method must be completed within the 90-day period. Significant delays on the part of the Customer may limit the scope of the program or result in additional charges.
5. COMPENSATION AND PAYMENTS
5.1 Payment Terms
- The Customer must make an initial payment before the start of the service.
- Monthly bills must be paid within a maximum period of 15 days to avoid interruption of services.
- Refunds are not made.
5.2 Service Extensions
The extensions of Operational Foundations must be negotiated before the end of the initial 90 days and may involve additional costs.
6. INTELLECTUAL PROPERTY AND CONFIDENTIALITY
6.1 Intellectual Property
The MindfulOps methodology and other tools used are the exclusive property of MindfulOps and its licensors. The Customer may not copy or use them outside the scope of this Agreement without prior written authorization.
6.2 Confidentiality
Both parties are committed to maintaining the confidentiality of all information exchanged during the collaboration. This obligation is maintained even after the end of the service.
6.3 Data Protection and Privacy Policy
The processing of the Customer's personal data will be carried out in accordance with the MindfulOps Privacy Policy, available in mindfulopshub.com/privacy-policy. By contracting our services, the Customer accepts the conditions described in this policy, including the use of technologies, third-party platforms and messaging services.
7. LIMITATION OF LIABILITY
MindfulOps will not be responsible for indirect or consequential damages, including loss of benefits. Your total liability will be limited to the amount paid by the Customer under this Agreement.
8. INDEMNITY
The Customer undertakes to compensate and release MindfulOps from liability for any claim or liability arising from non-compliance by the Customer.
9. TERMINATION
This Agreement may be terminated by either party upon written notification in the event of a breach. Payments made are not refundable.
10. APPLICABLE LAW
This Agreement will be governed by the laws of the State of Florida, USA. UU.
11. SMS MESSAGING SERVICE TERMS
By accepting these Terms and Conditions, the Customer authorizes MindfulOps to send occasional text messages (SMS) with account updates, reminders, promotions or other information related to the contracted services.
- The Customer can cancel the SMS service at any time by responding with “STOP”. You will receive a cancellation confirmation and no further messages will be sent.
- To reactivate the service, you can register again or reply with “START”.
- For support, you can respond with “HELP” or write to info@mindfulopshub.com.
- Message and data rates may apply. The frequency of the messages may vary. Check with your mobile provider.
- Mobile operators are not responsible for delayed or undelivered messages.
- MindfulOps complies with the standards established by the CTIA and with applicable legislation on privacy and mobile communications.
- All text message source data and the consent given will not be shared with third parties, except with the required aggregators and suppliers to provide the courier service.

1. INTRODUCTION
These Terms of Use are entered into between you and MindfulOps LLC (hereinafter, “MindfulOps”, “we” or “the Company”). By subscribing to The MindfulOps Hub (“the Subscription”) or using the website www.mindfulopshub.com (“the Website”) and associated Services, you agree to comply with these terms. Collectively, you and MindfulOps will be referred to as “the Parties”.
2. PARTS
The terms “you”, “your” or “user” refer to anyone who accesses, uses or subscribes to The MindfulOps Hub. The Subscription is intended only for users who are 18 years of age or older in your jurisdiction. By accepting these terms, you declare that you meet this requirement.
3. ACCEPTANCE OF THE CONDITIONS
These Terms regulate access to and use of The MindfulOps Hub, the Website and the Services provided by MindfulOps. By registering and accessing the Subscription, you accept these Terms of Use, the Privacy Policy and any other additional policies published by MindfulOps. We recommend that you regularly review these terms to stay informed of any changes.
4. MODIFICATIONS
MindfulOps reserves the right to update or modify these Terms at any time, at its sole discretion. The changes will be effective at the time of their publication on the Website. Continuing to use the Subscription after such changes constitutes your acceptance of them.
5. DESCRIPTION OF THE SUBSCRIPTION
The MindfulOps Hub is an exclusive membership that connects entrepreneurs and leaders in a space designed to move together toward success. As a member, you'll have access to resources, activities and opportunities that will help you strengthen your operations, create meaningful connections, and maintain balance between your personal and professional life.
6. REGISTRATION REQUIREMENTS
To access The MindfulOps Hub, you must:
Register on the Website by providing your full name, email, country of residence and valid payment method.
Create a username and password.
Complete the payment process to activate your membership.
You are responsible for maintaining the confidentiality of your account and for immediately reporting any unauthorized use.
7. FEES AND PAYMENTS
7.1 Subscription Fees:
Subscription rates will be published on the Website and may vary depending on the plan selected. MindfulOps reserves the right to change rates with prior notice.
7.2 Automatic Payments:
The Subscription operates on an automatic renewal model. By signing up, you authorize MindfulOps to process recurring payments based on your plan. You can cancel the automatic renewal from your account settings before the next billing cycle.
7.3 Refund Policy:
Due to immediate access to The MindfulOps Hub content and resources, refunds are not offered for payments made.
8. USE OF THE SUBSCRIPTION
8.1 Permitted Use:
Access and use of The MindfulOps Hub is for personal, non-commercial purposes only. You may not reproduce, distribute, or share the content with third parties without written permission from MindfulOps.
8.2 User Conduct:
You agree not to use the Subscription to:
Post offensive, defamatory, or illegal content
Disrupt the functionality of the Website or the Subscription.
Distribute viruses or other harmful code.
MindfulOps reserves the right to suspend or cancel your access in case of non-compliance.
9. INTELLECTUAL PROPERTY
All content, tools and resources available on The MindfulOps Hub are the property of MindfulOps and are protected by copyright and intellectual property laws. You may not reproduce, modify or use such content for unauthorized purposes.
10. CANCELLATION AND TERMINATION
10.1 Cancellation by the User:
You can cancel your Subscription at any time from your profile settings. However, refunds will not be issued for unused periods.
10.2 Termination by MindfulOps:
MindfulOps reserves the right to cancel your access to the Subscription in the event of a breach of these terms.
11. LIMITATION OF LIABILITY
MindfulOps will not be responsible for direct, indirect or consequential damages arising from the use of the Subscription. The Company also does not guarantee specific results derived from the application of shared resources and strategies.
12. INDEMNITY
You agree to compensate and hold MindfulOps harmless from claims, damages, or costs arising from your misuse of the Subscription or breach of these terms.
13. APPLICABLE LAW
This Agreement will be governed by the laws of the State of Florida. Any dispute will be resolved through binding arbitration in Miami, Florida.

1. INTRODUCTION
This agreement governs participation in the MindfulOps LLC Affiliate Program (hereinafter, “MindfulOps”). By registering as an affiliate (hereinafter, “Affiliate”), you agree to comply with these Terms and Conditions. If you don't agree, you should not participate in the program.
2. DESCRIPTION OF THE PROGRAM
Purpose of the Program: The Affiliate Program allows participants to earn commissions by promoting specific MindfulOps products and services.
Customer Restriction: Commissions only apply to new customers or members who have never previously interacted with MindfulOps. Current or previous customers don't qualify for commissions, even if they return to hire new services or products.
Promotion Tools: MindfulOps will provide materials and resources to facilitate the promotion of its services and products.
3. REQUIREMENTS AND ELIGIBILITY
Full Information: The Affiliate must ensure that referrals include their full name when registering or making their first purchase to validate the commission.
Legal Compliance: The Affiliate must act in accordance with all applicable laws and follow MindfulOps policies.
4. RELATIONSHIP WITH CUSTOMERS
New Customers: The Affiliate must ensure that the referrals are new to MindfulOps. If a customer already exists in our database, no commission will be generated, regardless of the referral method.
Customer Support: Affiliates must provide accurate information about MindfulOps services.
5. COMMISSIONS AND PAYMENTS
Payment Terms:
Commissions will only be paid by new customers who complete a valid purchase of MindfulOps products or services.
MindfulOps reserves the right to verify customer eligibility and refuse commissions for existing or previous customers.
Payment Deadline: Commission payments will be made within 30 days after the confirmation of the referral's eligible purchase.
6. DEADLINE AND TERMINATION
Duration: This agreement comes into effect upon registering as an Affiliate and can be terminated by either party with or without cause.
Termination for Breach: MindfulOps may terminate the agreement if the Affiliate violates the terms, uses deceptive practices, or damages the company's reputation.
7. LIMITATIONS OF LIABILITY
MindfulOps will not be responsible for interruptions, errors, or any loss resulting from participation in the Affiliate Program.
8. INDEMNITY
The Affiliate agrees to compensate and hold MindfulOps harmless against claims, damages or costs resulting from their actions as an Affiliate.
9. MODIFICATIONS TO THE PROGRAM
MindfulOps reserves the right to change these terms at any time. Continued participation in the program after changes implies acceptance of the changes.
10. APPLICABLE LAW AND DISPUTE RESOLUTION
This agreement will be governed by the laws of the state of Florida, USA Disputes will initially be resolved through direct negotiation.
11. FINAL PROVISIONS
Confidentiality: The Affiliate must protect all confidential information provided by MindfulOps.
Contractual Relationship: The relationship between the Affiliate and MindfulOps is one of independent contractors.
